These Terms of Service (TOS) constitute an integral part of the Hosting Agreement for athletesa.net. By utilizing our services, you acknowledge and agree to comply with our Acceptable Use Policy (AUP) along with these Terms of Service.

Service Rates:
You acknowledge the communicated nature of the service, rates, and charges outlined in the Hosting Agreement. The Company reserves the right to prospectively modify rates, with any promotional offer contingent upon cost of service goals.

Limitations:
For security reasons, specific ports are blocked by default for daily dedicated servers and VPS.

Payment and Taxes:
Service establishment is dependent upon receipt of the executed Hosting Agreement and payment of charges. Monthly and daily service payments are subject to the current tax rate imposed by the province of Ontario and Canada.

Refund and Disputes:
All payments are non-refundable. Overcharges or billing disputes must be reported within 30 days. Disputes proven valid under TOS and AUP incur an “Administrative Fee” of CAD$100.

Service Level Agreement (SLA):
a. The Company guarantees 100% network uptime.
b. Exclusions include scheduled maintenance, hardware and software maintenance, malicious attacks, and legal actions.

c. Backup responsibility lies with the Subscriber. In the event of SLA non-compliance, clients may request compensation for reported downtime.

Failure to Pay:
The Company may temporarily deny service or terminate the Hosting Agreement upon Subscriber’s failure to pay charges when due.

Default and Notifications:
Detailed notifications and timelines are provided for overdue bills and service termination. The Company may delete Subscriber’s data upon final default notification.

Servers Cancellation:
Subscribers can cancel servers at any time through their online accounts.

Termination due to Limited Technical Capacity:
The Company may deny service or terminate the Hosting Agreement if technical capacity is insufficient. Unused payments will be refunded.

Limited Liability:
The Company is not liable for damages resulting from Service interruption, with liability capped at charges for the affected period.

Disclosure to Law Enforcement:
The Company may disclose Subscriber information to Canadian law enforcement agents in cases of illegal activities.

Support Boundaries:
Technical support is limited to the Company’s expertise, excluding application-specific issues.

Inbound/Outbound DDoS Attacks:
Subscribers are responsible for securing accounts against DDoS attacks. The Company may investigate and take action against violators.

Privacy Policy:
The Company collects and protects Subscriber information, disclosing it only under specific circumstances as outlined in the Privacy Policy.

Revisions To This TOS:
The Company reserves the right to revise this TOS at any time, with notice provided to Subscribers.

Subscribers must provide valid contact information for notifications and communication.
